Why use arbitration

The difference of opinion that brings you in conflict with the other party is at an impasse. Nothing works. Each party maintains his/her position, i.e. his/her own point of view, his/her own interpretation. Positions seem to be irreconcilable for several reasons.

  • Arbitration can be NON-EXECUTORY where the arbitrator's decision is only used as a matter of opinion or recommendation.

  • Arbitration may be EXECUTORY where each party will need to conform to the arbitrator's decision.

  • You need a fast and low-cost decision (executory arbitration) or recommendation (non-executory arbitration).

  • Your contract includes an arbitration clause and you decide to take advantage of it.
